1. Tabisha Couture is a marketplace

Tabisha Couture, a DBA of Evolute LLC, a Texas limited liability company operates the Tabisha Couture marketplace.

Tabisha Couture operates an online marketplace that helps buyers discover and purchase South Asian fashion, jewelry, accessories, and related products from independent boutiques. Unless a page says otherwise, the boutique listing the item is the seller of record and is responsible for the product description, pricing, inventory, packaging, shipment, and any boutique-approved post-purchase accommodation.

Tabisha Couture may provide checkout, listing tools, private customer-to-boutique communications, and marketplace operations, but Tabisha Couture does not manufacture, own, inspect every item, or guarantee every statement made by an independent boutique. Tabisha Couture may apply risk and fraud controls for the protection of the platform and its payment partners; those controls are not a guarantee of any transaction and do not create a duty to a buyer or boutique.

Product and order questions must be sent to the selling boutique through the private order conversation. Tabisha Couture is not the boutique's customer-service representative and does not arbitrate, adjudicate, guarantee, or assume responsibility for resolving ordinary buyer-boutique product or order conflicts.

2. Accounts and eligibility

You must provide accurate information when using Tabisha Couture. You are responsible for activity under your account and for keeping your sign-in method secure. Vendor, founder, and administrator access may be limited to approved users. Tabisha Couture may suspend or restrict access if we believe an account is being misused, creates risk, violates these Terms, or is required to be restricted by law or a payment partner.

3. Orders, prices, and payment

Each boutique sets its merchandise price and shipping policy. Where Tabisha Couture is required and registered to collect marketplace-facilitator sales tax, Stripe calculates and adds that tax at checkout for Tabisha Couture to report and remit. Boutiques remain responsible for taxes not expressly collected and handled by Tabisha Couture. Checkout clearly shows any boutique-level shipping charge before payment. Available sizes and availability are shown before checkout. Payment processing is provided by Stripe and its affiliates. Card details are submitted to Stripe and are not stored on Tabisha Couture servers. The selling boutique accepts the order and forms the contract of sale with the buyer after checkout is completed and payment is authorized; Tabisha Couture is not a party to that contract of sale.

Tabisha Couture may charge boutiques the platform fee stated in each boutique's separately signed fee schedule. Buyers do not pay a separate Tabisha Couture marketplace fee unless a charge is clearly disclosed before checkout.

4. Shipping and delivery

Boutiques are responsible for packing and shipping purchased items within the processing time stated on the listing or checkout page. Delivery estimates are best estimates, not guarantees. Delays may be caused by carrier delays, weather, address issues, customs, failed delivery attempts, and events outside our control may affect delivery.

Shipping may be free, free above a boutique-defined threshold, or calculated from the destination and package through EasyPost. Free shipping never includes an Express upgrade unless separately disclosed.

Buyers are responsible for providing accurate delivery details and for any carrier fees, return costs, customs duties, taxes, or import charges caused by refused delivery, incorrect addresses, international shipment requirements, or buyer-requested delivery changes after dispatch.

5. Returns, refunds, and cancellations

By default, sales on Tabisha Couture are final and are not eligible for return, refund, or exchange unless the boutique chooses to approve an exception or applicable law requires a remedy. The selling boutique alone decides voluntary exceptions and communicates them directly with the buyer. Tabisha Couture provides checkout, documentation, and communication tools but does not arbitrate return requests. A boutique may use those tools to carry out its written refund, exchange, credit, or alteration decision.

Cancellation requests must be made promptly and may be declined after an item has shipped, been packed for dispatch, or entered custom preparation. Approved returns must be sent back in original condition, folds, packaging, tags, and accessories. Custom, personalized, sale, intimate, stitched, pre-stitched, petticoat, perishable, and digital items may be non-returnable unless damaged, defective, or materially misdescribed.

6. Product information and authenticity

Boutiques must provide accurate product information, including condition, fabric or material type, sizing, color, price, exact dimensions, border widths where applicable, included sub-items, shipping time, and any material limitations. Color and texture may vary by screen, lighting, photography, handwork, dye lot, or fabric behavior. Tabisha Couture prohibits counterfeit goods, unauthorized replicas, stolen goods, and listings that infringe intellectual property rights.

Handwoven, hand-dyed, embroidered, and handmade products may show slight inconsistencies in weave, texture, motif placement, tassels, edging, or finish. These characteristics can attest to handmade originality and are not defects unless they materially differ from the listing. If a product is described as Silk Mark Certified, the boutique must have a reasonable basis for that claim and should provide supporting tag, label, or certification evidence when requested.

Some listing descriptions, images, edits, backgrounds, styling scenes, or product visuals may be created, enhanced, or organized with AI-assisted tools. Such images may be representative of the garment, jewelry, fabric, silhouette, color family, styling, or product type rather than a perfect one-to-one depiction of the exact physical item. Buyers should review the title, written details, measurements, size notes, price, policy, and boutique communications before purchase.

7. User content and AI listing tools

Vendors may upload photos, descriptions, voice notes, measurements, and other listing material. You confirm that you have the rights needed to provide that content and authorize Tabisha Couture to use it to operate, market, display, and improve the marketplace. AI-assisted listing drafts are tools only; vendors remain responsiblefor reviewing and approving listing accuracy before publishing.

Tabisha Couture may display AI-use disclosures on product pages, policy pages, or other marketplace surfaces. Vendors must not use AI-assisted content to misrepresent condition, authenticity, brand, included pieces, size, or material facts about an item.

8. Prohibited conduct

You may not use Tabisha Couture to commit fraud, evade payment, list prohibited or infringing goods, scrape or attack the service, interfere with another user, misrepresent identity or item condition, manipulate reviews, bypass checkout, move a website transaction to an unapproved off-platform communication or payment channel, copy or reuse Tabisha Couture product assets without written permission, or violate law. We may remove content, cancel transactions, withhold access, or cooperate with payment processors and law enforcement when appropriate.

9. Third-party services

Tabisha Couture relies on providers such as Stripe, Supabase, Resend, analytics, hosting, carriers, and AI tooling. Your use of those features may be subject to their terms and privacy practices. Tabisha Couture is not responsible for third-party services outside our control.

10. Disclaimers and limitation of liability

Tabisha Couture is provided on an as-is and as-available basis. To the fullest extent allowed by law, Tabisha Couture disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and error-free operation. To the fullest extent allowed by law, Tabisha Couture will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or substitute goods.

11. Changes and contact

We may update these Terms as the marketplace grows. Material updates will be reflected by a new effective date and, where appropriate, additional notice. Platform, account, privacy, legal, safety, fraud, or technical questions may be sent to hello@evolute-llc.com. This address is not a product-inquiry or ordinary order-dispute channel; contact the selling boutique through the private order page instead. Nothing in these Terms limits action required by law, a regulator, a court, a payment network, or non-waivable consumer rights.
